When the Wwft applies to lawyers

The Wwft applies when you advise or assist with, among other things: buying or selling registered property, managing a client's money or securities, incorporating or managing companies, and buying or selling businesses. Litigation and determining a client's legal position are exempt.

Does the Wwft apply to all our work?

No. It only applies to the listed services, such as real-estate and corporate work. Litigation and determining a client's legal position are exempt. Per matter you first assess whether the Wwft applies; Cloudpliant is for the matters where it does.

Does this clash with legal privilege?

Not the due diligence itself: that happens inside your own file. The litigation exemption covers the reporting duty; where the Wwft applies, so does the duty to report to FIU-Nederland.

OpenSanctions (EU, UN, OFAC and national sanctions lists plus PEP registers), the Dutch business register (KvK) and the Central Insolvency Register.
